MISREPRESENTATION

CLAIM CIRCUMSTANCES

Misrepresentation is an all too common complaint. Whatever the brochure say, whatever you are told, whatever your ticket says - that is what you expect. If it fails to materialise in the format as stated it has clearly been misrepresented. Some flagrant examples are:
  • Hotel location - "close to beach" when it is five miles.
  • "Sea views" when there is a huge apartment block blocking your view.
  • "Four Star Accommodation" which hardly qualifies for a single star.
  • Swimming pool which is drained for maintenance.
  • "Friendly staff" who are anything but friendly.
  • Room or cabin facilities which are not as stated.
  • Common facilities which are not as stated.
  • Camping facilities which are not as stated.
  • The hotel in the brochure is not the actual hotel.
  • Out of date pictures of the surroundings - a chemical complex is now built next door.
There are many more instances but clearly if the brochure is misleading this is misrepresentation and you have a claim. It is interesting to compare actual photographs with those in the brochure and actual descriptions with those of witnesses.

If your claim is suitable for the Small Claims Track we will confirm any details with you and contact the Defendant by post. The Defendant will be given 10 days to respond. After the ten days you can then decide if you want to issue proceedings.
